Agreement to Terms

By accessing or using EstateKart.ai's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including NRI investors, property buyers, and visitors to our platform.

Services Description

EstateKart.ai provides the following services for NRI real estate investment:

  • Property search and discovery in India and Dubai
  • End-to-end property purchase facilitation
  • Home design, architecture, and interior coordination
  • Construction management with live video updates
  • Legal documentation and compliance support
  • Rental management and tenant services
  • ROI tracking and investment analytics
  • Loan and mortgage assistance

User Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be a Non-Resident Indian (NRI), Person of Indian Origin (PIO), or Overseas Citizen of India (OCI) for India properties
  • Have valid identification documents as per KYC requirements
  • Comply with FEMA (Foreign Exchange Management Act) regulations for India investments
  • Meet UAE residency or foreign ownership requirements for Dubai properties
  • Provide accurate and complete information during registration

User Account

When you create an account with us:

  • You are responsible for maintaining the confidentiality of your login credentials
  • You agree to notify us immediately of any unauthorized account access
  • You are responsible for all activities under your account
  • We reserve the right to suspend accounts that violate our terms
  • One person may maintain only one account unless authorized otherwise

Payments and Fees

Service Fees

  • Property search and consultation: Free
  • Transaction facilitation: 1-2% of property value
  • Design and construction management: As per project scope
  • Rental management: 8-12% of monthly rental income
  • Legal services: Quoted separately based on requirements

Payment Terms

  • All property payments must be made through approved banking channels
  • International wire transfers must comply with FEMA guidelines
  • Service fees are non-refundable once services are rendered
  • Payment schedules for construction projects follow milestone-based billing

Property Listings

Regarding property information on our platform:

  • Property details are provided by developers, sellers, and our verification team
  • While we strive for accuracy, you should independently verify all property information
  • Prices, availability, and specifications are subject to change without notice
  • Images and virtual tours are representative and may differ from actual property
  • ROI projections and rental estimates are indicative and not guaranteed

Prohibited Activities

You agree not to:

  • Provide false, inaccurate, or misleading information
  • Use our services for money laundering or illegal activities
  • Circumvent any content-filtering techniques we employ
  • Scrape or copy property listings without authorization
  • Interfere with the proper functioning of our platform
  • Impersonate another person or entity
  • Use automated systems without our prior written consent
  • Violate any applicable local, state, national, or international law

Disclaimers and Limitations

No Guarantee

EstateKart.ai does not guarantee:

  • Property value appreciation or investment returns
  • Rental income or occupancy rates
  • Construction timelines (delays may occur due to various factors)
  • Approval of loans or mortgages

Limitation of Liability

To the maximum extent permitted by law, EstateKart.ai shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or investment value
  • Actions of third-party service providers
  • Government policy changes affecting property ownership
  • Force majeure events

Intellectual Property

  • All content on our platform is owned by EstateKart.ai or its licensors
  • You may not reproduce, distribute, or create derivative works without permission
  • The EstateKart.ai name, logo, and branding are protected trademarks
  • Property images are owned by respective developers or photographers

Cancellation and Refunds

  • Property booking cancellations are subject to developer/seller policies
  • Service fees are generally non-refundable once work has commenced
  • Construction project cancellations follow milestone-based settlement
  • Refund requests must be submitted in writing within 30 days

Governing Law and Disputes

  • These terms are governed by the laws of India for India properties
  • UAE laws apply for Dubai property transactions
  • Disputes shall first be attempted to resolve through mediation
  • Unresolved disputes will be subject to arbitration in Mumbai, India
  • You waive any right to participate in class action lawsuits

Indemnification

You agree to indemnify, defend, and hold harmless EstateKart.ai, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or platform notification at least 30 days before they take effect. Your continued use of our services after modifications constitutes acceptance of the updated terms.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
